This website is operated by Sugar Pony. Throughout the site, the terms “we”, “us” and “our” refer to Sugar Pony. Sugar Pony offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

 

Shipping/Delivery 

We are a home-based small business, so we appreciate your understanding of our process and delivery times. Our sweet treat bouquets are made to order and as such have a 3-5 business day processing turnaround. 

We work with a number of reputable couriers to be able to offer delivery Australia-wide.

Unfortunately we do not offer same or next-day delivery. We cannot guarantee delivery days or times, we can only offer an estimated 1-4 business days from when the gift leaves us. The couriers we choose to use have their own policies and guidelines. If a destination doesn’t fall within our couriers’ delivery areas there may be an additional cost and you will be notified.

Payment Terms

We accept payments through Stripe or PayPal.

Third party payment services including these can sometimes overwrite your information. Please ensure the correct shipping information is on your confirmation email and if not, contact us immediately.

We will not be liable for any fees or charges to you by your financial institution.  

 

Billing Information

You will receive an email confirmation of your order but we do not send paper copies with our bouquets, as most often they are sent as a gift direct to the recipient. Please ensure the information on your order confirmation is correct and notify us immediately if not.

 

Your Obligations When Placing An Order

Please ensure all information you provide on the order form is correct. Correct contact information for yourself as the purchaser is crucial in case we need to contact you about your order. You must also make sure the recipient information is correct so we can deliver to the right address! There can be delays or re-direction required from incorrect information, which leads to additional delivery fees on you. Please ensure a correct mobile number for the recipient in case we need to contact them. If the gift is delivered at the wrong address but it is the one you gave us, we cannot recover the item and it will not be eligible for replacement or refund.

If you choose to add a personalised message to the gift at checkout, it is your responsibility to type it exactly as you want it to appear (including spelling and grammar). If we feel the content of any personalised message may bring us into disrepute, we have the sole discretion to vary or even delete it.

 

Personal Information

Any personal information provided by you through the store is governed by our Privacy Policy.

 

Trademarks, Copyrights and Restrictions

Any material on our website is for personal, non-commercial use. This material may not be reproduced, modified, copied, uploaded, distributed or posted in any way – including email and other electronic means – without obtaining written consent from us.

 

PRODUCTS

 

Quality and Availability

We use quality products from reputable brands to create our bouquets. Our plushie centrepieces will always be sent as ordered but we reserve the right to use alternate products to fill the bouquets in place of out of stock/unavailable items. Any substituted items will be of equal or greater value than the original item. For this reason, we don’t list the exact selection of chocolates or lollies used in each bouquet, just the total number of items.

Our plushies have limited quantities so exchanges or returns will be in line with our Refunds & Returns Policy.

 

Appearance

While every effort has been made to display true representation of the colours of our bouquets, we cannot guarantee they match what your computer or phone screen shows and slight variations may occur.

Our product descriptions are as accurate as possible, with plushie measurements being approximate due to slight differences beyond our control.  

Our bouquets are individually crafted and cannot present exactly as shown in the photos. Each bouquet is unique and the designs may vary.  

 

Pricing

Our prices are listed in AUD and we do not ship internationally. Product prices are subject to change without notice. Currently our prices do not include GST. We are not liable to you or any third-party for any changes, modifications or discontinuance of our products.

Prices are clearly stated for each type of bouquet being:

  • $115 for Cadbury/Mars/Nestle bouquets

  • $115 for Lolly bouquets

  • $130 for Ferrero or Lindt bouquets

This price includes a plushie of your choice but does not include postage. See our Delivery Policy for more information.

 

Allergies

Our bouquets contain or may contain dairy, nuts, sulphites, wheat, gluten and/or soy. We are not responsible for any allergic reaction to any of the products used in our bouquets. You must carefully consider this when placing your order.

 

Cancellation/Refunds/Returns

A cancellation of an order will be considered up to 48 hours after purchase. If the cancellation is approved, the order amount will be refunded to the same payment method used to purchase the order less an administration fee.

We will not be liable for any fees or charges to you by your financial institution.

Complaints

We encourage you to communicate any dissatisfaction with our service via email at info@sugarpony.com.au

Complaints must be made within 2 days of delivery of your order and must be accompanied by photos and reasonable grounds for the complaint.

If we require your order to be returned to us, you must co-operate for collection of said order.

 

Indemnification

You agree to indemnify, defend and hold harmless The Sweetest Fang and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
